1. Intellectual Property

FAAToday.com (the “Site”) is owned and operated by FAA Today, LLC (“FAA Today”). All of the content displayed on the Site, including text, graphics, photographs, images, logos, video, and audio (the “Content”) is the sole and exclusive property of FAA Today. All elements of the Site, including site design, site construction, location of content, arrangement of pages, html code, xml code, text fields, and user interactive features (the “Site Elements”) are the sole and exclusive property of FAA Today. All Content and Site Elements are protected by national and international laws, including copyright, trademark, and other intellectual property laws. Any Content or Site Elements accessed by You shall in no respect transfer any right, title, or interest in any such Content or Site Elements. No Content or Site Elements may be used, copied, displayed by You except as expressly permitted herein.

2. Use Restrictions

FAA Today takes no responsibility, assumes no liability, and makes no representations as to the accuracy of any User Content posted on the Site. FAA Today does not make any representations as to the accuracy of User Content that may appear on the Site. FAA Today is not responsible for any loss or damage resulting from anyone’s reliance on information or content posted on the Site.

5. Indemnification

You hereby indemnify, defend and agree to hold harmless FAA Today and its officers, employees, agents, representatives, and affiliates from and against any and all claims, actions, proceedings, suits, liabilities, damages, settlements, penalties, fines, losses, or expenses, including attorneys' fees and costs, arising out of or in any way connected with your access to and use of the Site, including claims arising out of alleged or actual trademark infringement, copyright infringement, defamation, libel, or violation of privacy.

6. Severability

If any provision of these Terms of Use is deemed unlawful, void, or for any reason unenforceable, then that provision will be deemed severable from these Terms of Use and will not affect the validity and enforceability of the remaining provisions. The affected provision shall be modified to the extent necessary to make it lawful, not void or enforceable, as the case may be, in such a manner as comes closest to preserving the intentions of such provision.

7. Governing Law

These Terms of Use will be governed and construed in accordance with the laws of the State of Delaware without regard to its conflicts of laws provisions. In any dispute between You and FAA Today where FAA Today prevails, FAA Today shall be entitled to recover its reasonable attorney fees, court costs, disbursements, and other legal expenses.
